Risk Control

Due diligence is a personal obligation. It attaches to officers individually—to the decisions they made, what they knew at the time, and the active steps they took to ensure risk was being properly managed. It is not satisfied by delegation, policy approval, or an organisation's general compliance program.

The scrutiny applied to officers in a prosecution or regulatory investigation is specific and retrospective. It examines what was known, what was decided, and whether genuine steps were taken. A governance structure that cannot demonstrate active engagement with risk will not withstand that examination.

We advise on due diligence obligations and align governance, oversight, and decision-making with what the law requires—building a posture that holds up when it is tested.

Defining what must be done is not the same as ensuring it occurs in practice. Controls that are selected but not properly implemented—or implemented but not embedded into how work is performed—do not reduce exposure. They produce a record of action that does not reflect operational reality, which can itself become a liability.

We direct and support implementation of control measures in the environments where work is performed—ensuring they are proportionate to the risk, applied in practice and operating as intended. Where existing controls are inadequate, we define what rectification requires and support the process of achieving it.

Duty in WHS is not distributed uniformly. It attaches differently across the organisation—from workers to supervisors to officers—and each must understand what the law requires of them in practice.

Workers must understand the hazards they face and the controls that apply. Supervisors must understand what adequate oversight requires. Officers must understand what the law demands of them personally—and be able to demonstrate that their decisions reflected it.

Systems that do not reflect how work is actually performed do not manage risk. Generic frameworks built at a distance from operations create a gap between what is documented and what happens in practice—and that gap is itself a source of exposure.
